PORTER, Justice.

This case is concerned with a collision between the automobilés of appellant and respondent. The accident occurred on State Highway No. 8 about three miles east of Moscow, in Latah County, on May 10, 1947, at about nine o’clock P.M.

In his complaint, appellant alleged that at the mentioned time and place, he was driving his automobile in an easterly direction on the extreme right of said highway in a careful and prudent manner, and that at the same time and place, respondent was driving his automobile in a westerly direction on said highway, and carelessly, negligently and…
