Inmate Harry Weeks sued prison medical director L.R. Chaboudy under the Eighth Amendment for “deliberate indifference to serious medical needs” in violation of Estelle v. Gamble, 429 U.S. 97, 104, 97 S.Ct. 285, 291, 50 L.Ed.2d 251 (1976). The District Court, Weber, J., granted plaintiff’s motion for summary judgment on the issue of liability, determined plaintiff’s damages to be $50,000, and ordered defendant to pay plaintiff $5,000, or 10% of the total damages.
