This was an action in assumpsit brought, by the respondent to recover A sum alleged to be due it by the petitioner under the terms of a car leasing agreement. The answer admitted the execution of the agreement but pleaded that payment of the sum demanded would amount to the making of a rebate, contrary to the provisions of the Elkins Act. 1 The District Court rendered judgment for the petitioner which the Circuit Court of Appeals reversed, holding the respondent entitled to the full amount claimed. 2 We granted certiorari on account of the importance of the question involved and of the…
