Plaintiff appeals from an order granting judgment on the pleadings in favor of defendants, wherein plaintiff seeks to compel specific performance of a certain agreement involving the Piedmont Apartments, located in the city of St. Paul.

The amended complaint alleges the following facts: On December 31, 1940, the Baltimore Investment Company, in which plaintiff was an officer and director, owned the apartments subject to a mortgage in favor of one Burns, which had been foreclosed and sold at sheriff’s sale for $11,000.
