Weaver Bros., a partnership composed of T. L. and S. P. Weaver, and engaged in the lumber business at Shreveport, La., in 1921 sold to Hamon and Kell, an alleged partnership composed of Jake L. Hamon and Frank Kell, certain bills of lumber and building material for use in the construction of the Wichita Falls, Ranger Fort Worth Railroad Company. The plaintiffs on March 21, 1922, sued for a balance alleged to be due on said account, amounting to $4,702.06, with interest, making Frank Kell, individually, J. W. Mitchell, and Frank L.
