— This is a petition for a declaratory judgment filed under the Uniform Declaratory Judgments Act of June 18,1923, P. L. 840,12 PS §831 et seq. as amended. The petition raises for the first time in Pennsylvania, so far as we are informed, the question of whether the rights and obligations of insured and insurer may be determined in proceedings for a declaratory judgment. After proper service, no appearance or answer was filed by respondents so *232that the averments of fact in the petition may be taken as true. They are as follows:
