— The history of this case may be found in the opinion of Justice Head on the former appeal, 24 S. W. Rep., 952, and need not be repeated.

Instead of conforming to the views there so clearly expressed, appellees upon the next trial again insisted upon the original judgment against the receiver, rendered after his discharge, as conclusive against appellant, and erroneously caused it to be read in evidence to the jury.
