1Opinion of the Court

This is an appeal from the granting of a temporary injunction by the superior court of Muskogee county. On July 15, 1919, the defendants in error filed a petition in that court seeking to enjoin the plaintiff in error from building a proposed gasoline filling station at the intersection of Twelfth street and Okmulgee avenue in the city of Muskogee. The petition charged that the contemplated gasoline filling station would constitute a nuisance.
