The attorney for the city ojf Birmingham has filed an extensive brief on the application for a rehearing as amicus curise. He cites no statute and no ordinance, and' no decision save that of Childers v. State, 156 Ala. 96, 47 South. 70 (overruled by this decision), which would authorize or justify an arrest like the one in question. The most that any of the decisions or the text-books hold is that the Legislature may authorize an officer to make an arrest for a misdemeanor committed in his presence, or on probable cause that the offense was committed.…
