B‘. E. Buffaloe & Company, hereinafter referred to as complainants, have appealed from, a decree of the chancery court dismissing their bill. The bill was filed December 28, 1923, against J. Walter Jones, the Board of Education of Memphis, the Hartford Accident & Indemnity Company and also against the City of Memphis. It appears that a demurrer filed on behalf of the City of Memphis was sustained and' no exception or assignment is now made as to the action of the court in dismissing the bill as to the City of Memphis.
