MEMORANDUM OPINION

KISER, Senior District Judge.

Before me now are defendants Danek Medical, Inc., Sofamor Danek Group, Inc., and Sofamor, Inc.’s (collectively “Danek’s” or “defendant’s”) motion for summary judgment.
