On January 2, 2003, defendants Instituto de Banca y Comercio, Inc., et al., (hereinafter “Instituto”) moved for partial summary judgment to dismiss the complaint on the first and third counts (failure to give written notice of their continuation of coverage rights and failure to respond to letter requesting continuation of coverage under company’s medical plan, respectively (D.E.
