OPINION

TSOUCALAS, Judge:

Plaintiff, Bunker Limited Partnership, on behalf of the former employees of Crescent Silver Mine, Incorporated of Big Creek and Kellogg, Idaho, brings this action to contest a final determination by the Secretary of Labor (“Secretary”) denying Crescent’s employees eligibility to apply for worker adjustment assistance under the Trade Act of 1974, §§ 221-249, 284, 19 U.S.C. §§ 2271-2321, 2395 (1982 & Supp. IV 1986) (hereinafter the “Trade Act”).
