This is an action for declaratory and in-junctive relief brought by Exxon Corporation against the Department of Energy (“DOE”)1 and Wayne E. Gifford, Deputy Regional Director of Region VI of the Federal Energy Administration (“FEA”). Gif-ford is sued solely in his official capacity.
