Presently pending in this civil action is defendants’ motion to dismiss or, in the alternative, for partial summary judgment. Defendants here seek dismissal of the first amended complaint filed by plaintiffs in PPM America, Inc., et al. v. Marriott Corp., et al., No. H-92-3068. 1 The defendants in this action are Marriott Corporation, J. Willard Marriott, Jr., Richard E. Marriott, and Stephen F. Bollenbach.
