Plaintiff alleges that he was removed from the position of Chief of the Nevada Bureau of Alcohol and Drug Abuse (“BADA”) in violation of the Rehabilitation Act of 1973 § 504, 29 U.S.C. § 794, and the due process clause of the fourteenth amendment. Specifically, Plaintiff claims that he lost his job because he was an alcoholic, although (he alleges) he was fully able to perform the duties of his office despite his affliction.
