This is an appeal from the following order or judgment of the superior court of Okanogan county:
“It is hereby ordered, adjudged and decreed, that the clerk of this court enter this order, showing that on the 27th day of September, A. D. 1904, the said Honorable C. Victor Martin, while sitting as the presiding judge of this court, in open court, announced to said defendant that, unless he, the said defendant, apologized to him, the said Hon. O.
