MEMORANDUM
RAYMOND J. BRODERICK, District Judge.
Defendant Guido Frezzo has moved this Judge to recuse himself from presiding over Frezzo’s impending criminal jury trial in which he is charged with conspiracy and receiving stolen property. Defendant contends that this Judge’s impartiality in the present case may reasonably be questioned since this Judge presided over a previous criminal jury trial of the defendant, which resulted in his conviction for violating the Federal Water Pollution Act.
