These consolidated appeals stem from an injury sustained by Andre Robertson at a construction site in Southeast, Washington. In No. 92-CV-538, the District of Columbia (“District”) appeals the trial court’s denial of its motion for judgment as a matter of law after a jury returned a verdict in Robertson’s favor.
