Woodward v. United States

District of Columbia Court of Appeals

1Opinion of the Court

KING, Associate Judge:

Appellant was convicted of possession with intent to distribute cocaine, in violation of D.C.Code § 33-541(a)(l) (1989). On appeal, appellant contends that: (1) his due process rights were violated when the trial court denied him the opportunity to call a government witness who had already testified and been cross-examined by his counsel, and (2) the trial court erred by failing to make an on-the-record inquiry of him to ensure that he had made a knowing, intelligent and voluntary decision not to testify. We reject both contentions, and affirm.
