The plaintiff brought this action for a divorce upon the ground of intolerable cruelty. The defendant’s answer denied the allegation of cruelty, and sought a divorce upon a novel cross-complaint alleging “bigamy,” and, by amendment, added an additional count alleging fraudulent contract. The plaintiff offered no evidence in support of the complaint and the defendant introduced evidence upon the count of fraudulent contract.
