MEMORANDUM AND ORDER

ROBSON, Senior District Judge.

This cause is before the court on the motion of the defendant Joseph Calif ano, Jr., the Secretary of Health, Education and Welfare (hereinafter Secretary) for summary judgment. For the reasons hereinafter stated, the motion shall be denied and the case shall .be' remanded to the Secretary.
