OPINION
PAYNE, Justice.
The defendant was tried to a jury on a charge of murder in the first degree. Lesser included offenses of second-degree murder and voluntary manslaughter were also submitted for the jury’s consideration. At the conclusion of the trial and after deliberation by the jury, the foreman announced ■ that the jurors were deadlocked and unable to reach a verdict. The defendant was tried a second time and found guilty of murder in the second degree.
