Defendant was sentenced to death for the murder of Essie Mae Hodson. This appeal is automatic. (Pen. Code, § 1239, subd. (b).)

There have been three trials. In the first, defendant was found guilty of first degree murder and sentenced to death. On automatic appeal we affirmed the judgment. (People v. Griffin, 60 Cal.2d 182 [32 Cal.Rptr. 24, 383 P.2d 432].)
