MEMORANDUM AND ORDER

HARRINGTON, District Judge.

This matter is before the Court on a Petition for Writ of Habeas Corpus filed on June 19, 1998. Milton K. Almon, the Petitioner, who is subject to an order of deportation, seeks a court ruling that he is entitled to a hearing determining whether or not he should receive a waiver from deportation because of humanitarian factors — commonly known as Section 212(c) of the Immigration and Nationality Act (“INA”) relief.
