MEMORANDUM AND ORDER
MAGNUSON, Chief Judge.
This matter is before the Court upon Defendants’ motion for summary judgment. For the following reasons, the Court grants the motion.
BACKGROUND
Plaintiffs Fischer Sand and Aggregate Company and related entities (Plaintiffs) sought permits to open a gravel mine in Apple Valley, Minnesota, from the City of Apple Valley and other government bodies with jurisdiction.
