Appeal from a judgment of the Supreme Court, Monroe County (David D. Egan, J.), rendered February 13, 2003. The judgment convicted defendant, upon a juiy verdict, of criminal possession of a controlled substance in the third degree, criminal possession of a controlled substance in the fourth degree, criminally using drug paraphernalia in the second degree (two counts) and unlawful possession of marihuana.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
