Appeal from a judgment of the County Court of Schenectady County (Harrigan, J.), rendered September 16, 1988, upon a verdict convicting defendant of the crimes of sodomy in the first degree, sexual abuse in the first degree (four counts) and assault in the third degree.

Defendant was indicted and charged with committing rape in the first degree, sodomy in the first degree, six counts of sexual abuse in the first degree and assault in the third degree, which allegedly occurred on three separate occasions on and between December 26, 1986 and January 18, 1987.
