Appeal from a judgment of the Supreme Court (Ingraham, J.), rendered June 1, 1987 in Cortland County, upon a verdict convicting defendant of the crime of assault in the second degree.
Defendant contends that the proof at trial was insufficient to support the verdict convicting him of assault in the second degree. Pursuant to Penal Law § 120.05 (3), a person commits assault in the second degree when "[w]ith intent to prevent a * * * police officer * * * from performing a lawful duty, he causes physical injury to such * * * police officer”.
