Plaintiffs, the proponents of a successful Peoria County referendum, filed in the circuit court of Peoria County a complaint to obtain a writ of mandamus commanding the defendants, the County of Peoria and Mary E. Harkrader as Peoria County clerk, to implement and enforce the referendum. During the circuit court proceedings, 10 incumbent members of the Peoria County Board were allowed to intervene and joined defendants in moving to dismiss the complaint.
