This is an action by the beneficiary named in a policy of life insurance to recover the face amount of the policy on the death of the insured. The question involved in this appeal is whether the policy was in force at the time of the insured’s death.

In answer to plaintiff’s statement of claim alleging that the policy was issued, the premiums were paid and the insured had died, the defendant replied that the policy had lapsed for failure to pay in time a premium, which was due on July 4, 1932, with a period of grace of one month.
