The Home Life Insurance Company of America, defendant below and appellant here, on August 24,1923, issued a policy of life insurance on the life of Antonio Gross for one thousand ($1,000) dollars in which Mary Gross, his wife, was named the beneficiary. The premiums were payable quarterly in the amount of eight dollars and fifty-seven cents ($8.57) per quarter and fell due on the 24th day of February, May, August and November of each year.
