The plaintiff filed this bill in equity against the defendant, The Penn Mutual Life Insurance Company of Philadelphia, praying for specific performance of a contract of life insurance in accordance with its terms, and for an accounting, and for discovery in aid of his proof. The policy in question was issued by the defendant company to the plaintiff on December 1, 1891, for $25,000, on what was known as the “accumulated surplus” plan. The annual premium was $1,516.50, to be paid during a period of ten years, and it was stipulated that the accumulated surplus…
