Pending before the Court is the appeal of Plaintiff/Appellant Werner V. Herzig (“Herzig”) from an October 10, 1996 Order of the United States Bankruptcy Court for the Eastern District of New York (Conrad, B.J.) in the above-referenced adversary proceeding, which granted the cross-motion of Defendant/Appellee Park Avenue Leasing Corp. (“Park Avenue”) for summary judgment and dismissed Herzig’s Complaint, which had sought a declaration pursuant to Bankruptcy Rules 7001(6) and (9) that a debt due and owing Park Avenue by Herzig was dischargeable.
