The plaintiff in error was convicted at the New York Oyer and Terminer held in December, 1879, of murder in the first degree in killing Maria Dichaco Balbo, his wife, by stabbing her in the neck with a knife on the night of September 30, 1879. The prisoner alleges two grounds of error, first that the court improperly overruled his challenge of Edward H. Betts one of the jurors in the case, and second, in admitting in evidence the prisoner’s confession made to a police officer while the latter held him in custody, under the circumstances which will be stated hereafter.
