It is undisputed that the check of $3,879.72, given by the Mutual Building & Savings Association, and payable to' the order of the plaintiff, on the National Exchange Bank, January 10, 1898, was a genuine check, given on account of an existing indebtedness, and was the property of the plaintiff when received by Myers, and was paid in due course by the National Exchange Bank.
