This case was here upon, a former appeal from a judgment in favor of the plaintiff, and was reversed for error in the admission of evidence. 92 Wis. 1. Subsequently the cause was retried, and at the close of the trial the jury returned a special verdict, to the effect (1) that the defendant, before the execution and delivery of the written contract, did make statements to the plaintiff as to the quantity of timber on the lands described in the contract; (2) that before the execution of the contract be represented to the plaintiff that there were 1,500,000 feet of nine-log timber on the lands;…
