MEMORANDUM AND ORDER

THEIS, District Judge.

This matter is before the court on plaintiffs motion for reconsideration of the court’s earlier order dismissing plaintiffs claim for lack of subject matter jurisdiction. (Doc. 66). Plaintiff is a citizen of Wisconsin who brings a wrongful death action against a Kansas citizen. The decedent was also a citizen of Kansas. By its earlier Memorandum and Order, this court held that for purposes of diversity jurisdiction, a person bringing a ■wrongful death action under Kansas law is deemed a citizen of the same state as the decedent.
