MEMORANDUM OF DECISION AND ORDER DENYING DEFENDANT’S MOTION TO DISMISS

Now before the Court is Defendant’s Motion to Dismiss the Indictment (Docket Item No. 11) charging him with two counts of making a false statement in connection with his attempts to purchase firearms, in violation of 18 U.S.C. § 922(a)(6). In his Motion to Dismiss, Defendant argues that. 18 U.S.C. 922(g)(8), the provision that puts his acts within the purview of section 922(a)(6), is unconstitutional facially and as applied to him.
