MEMORANDUM DECISION AND ORDER DENYING MOTION TO DISMISS INDICTMENT

This matter is before the Court on Defendant’s Motion to Dismiss Indictment, filed December 18, 2008. 1 Defendant was charged in the Indictment with one count of Possession of a Firearm following a Domestic Violence Conviction, in violation of 18 U.S.C. § 922(g)(9). 2 Defendant argues that the statute, as applied, is unconstitutional because it impermissibly infringes on his Second Amendment right to keep and bear arms.
