INTRODUCTION
This is an action alleging federal claims, under the Federal Tort Claims Act (“FTCA”), against the United States and the Department of Veteran’s Affairs (“VA”) (collectively “the United States”), and state-law claims for medical malpractice, against the University of Rochester (“U of R”) and Shobha Boghani (“Boghani”). Now before the Court is a motion [# 41] by the United States to dismiss the FTCA claims for lack of jurisdiction, and a motion [# 25] by the U of R and Boghani for summary judgment.
