Plaintiff in error, hereinafter referred to by name or as defendant, seeks reversal of a judgment of the Superior Court of the City and County of Denver entered upon a verdict finding him guilty of the offense of driving a motor vehicle while under the influence of intoxicating liquor.
The questions we are called upon to determine are: (1) Whether the defendant was entitled “to be set at liberty” for the reason that the case was not tried in the Superior Court until more than two terms of court had expired following the docketing of the cause in said court on appeal from the municipal court;…
