This suit involves the construction of an instrument offered as the last will and testament of Henrietta Prinz, deceased. The instrument was presented by the plaintiff in error for probate and its probate was contested by the defendants in error. Henrietta Prinz had married twice, her husbands being brothers, and died March 28, 1923, suddenly, of heart failure. The instrument offered was dated March 17, 1905, and on the. 14th day of December, 1917, Henrietta Prinz executed a codicil to thé instrument dated March 17, 1905.
