Defendant Michael Makings had an integral role in LeapSource, Inc., a now defunct business process outsourcing company. In late 2000, he assumed the responsibilities of LeapSource’s Chief Operating Officer (“COO”). DSOF (doc. 341), exh. 20 thereto at 83. For a short time, beginning on February 27, 2001, until roughly mid-March, 2001, Mr. Makings was Chief Executive Officer (“CEO”) and a director of LeapSource. Doc. 324 at ¶ 5 (citation omitted).
