1. We are of the opinion that the court erred in sustaining the demurrer to the petition, the substance of which is set-out in the foregoing statement of facts. Art. 7, sec. 7, par. 1, of the constitution of the State (Civil Code (1910), § 6563) provides that " The debt hereafter incurred by any county, municipal corporation, or political subdivision of this State, except in this constitution provided for, shall not exceed seven per centum of the assessed value of the taxable property therein, and no such county, municipality, or division shall incur any…
