I. INTRODUCTION

Plaintiff Cheri J. Kintz (“Kintz”) filed suit against her employer United Parcel Service, Inc. (“UPS”) alleging that UPS discriminated against her on the basis of her sex and disability in violation of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §§ 2000e et seq. (“Title VII”) and the Americans with Disabilities Act, 42 U.S.C. §§ 12101 et seq. (“the ADA”).
