MEMORANDUM OPINION

ELLIS, District Judge.

This telecommunications services dispute presents the following questions:(1) Does the two-year statute of limitations in § 415(b) of the Federal Communications Act (FCA) 1 apply to state law causes of action?(2) Can parties, by contract, agree to a limitations period shorter than the two-year period prescribed in § 415(b)?(3) Does a claim for failure to pay a recurring monthly charge for telecommunications services arise when each monthly invoice becomes due and payable rather than at the conclusion or termination of the service contract?
