OPINION

BRUGGINK, Judge.

Pending are defendant’s motion to dismiss Count XII of plaintiff’s amended complaint for lack of subject matter jurisdiction and defendant’s motion to quash subpoenas. In its motion to dismiss, defendant asserts that Count XII sounds in tort, rather than in contract, and thus Count XII is not within the jurisdiction of the court. See 28 U.S.C. § 1491(a)(1) (1988). Further, defendant argues that dismissal of Count XII is warranted because the damages sought under that Count include attorney’s fees and other consequential damages that cannot be awarded in this case.
