In April 1955 defendant-plaintiff in error was indicted by the grand jury of the circuit court of the first judicial circuit of the Territory of Hawaii for carnal abuse of a female under twelve years of age. The indictment alleged the defendant, in the City and County of Honolulu, and sometime during the months of October and November 1949, did carnally abuse a female child under the age of twelve years named therein.
