PARSONS, J.

Defendant was convicted in the circuit court of assault with intent to rape one Harrietta Vossberg. The case is before us on defendant’s bill of nineteen exceptions.

Exception one is to the court’s denial of defendant’s motion for a directed verdict of not guilty made at the conclusion of the prosecution’s opening statement to the jury upon the grounds that said opening statement conclusively showed that the defendant did not commit the crime charged in the indictment, that it contained no offer of proof corroborative of the statement of the prosecuting…
